These Terms of Use govern your use of the Mohassa platform across all its portals (real estate agency, partner, and platform administration).

1Introduction and acceptance of terms

These terms govern your use of the Mohassa platform across all its portals (real estate agency, partner, and platform administration). By using the Platform or creating an account on it, you acknowledge your acceptance of these terms in full. If you do not agree, you must stop using the Platform.

2Description of the service

Mohassa provides a tool for managing shared real estate investment projects, including:

  • Registering real estate projects, their details, and areas.
  • Managing partners and their ownership shares by square meter.
  • Recording development expenses and revenue.
  • Calculating and distributing profits, and tracking dues and payouts.
  • Providing financial reports and statistics to authorized users.

3Eligibility and account creation

Use of the Platform is limited to persons with full legal capacity to contract under Saudi law, whether acting as a representative of a real estate agency, a partner, or a platform administrator. Users must provide accurate and up-to-date information when registering, and must keep their sign-in credentials (mobile number and verification code) confidential.

4User roles and permissions

  • Platform administration: general oversight of registered agencies and users, supporting compliance and operations.
  • Real estate agency: full management of its projects, partners, expenses, revenue, and dues.
  • Partner: read-only access to their own ownership, profits, and dues, without visibility into other partners' data.

5User obligations

  • Provide accurate information and update it when it changes.
  • Not share sign-in credentials with any unauthorized party.
  • Use the Platform only for lawful purposes and in accordance with applicable Saudi law.
  • Not attempt unauthorized access to the data or accounts of other users.
  • Not upload content that violates applicable law or infringes the rights of others.

6Intellectual property

All rights relating to the Platform, including its design, source code, and the "Mohassa" trademark, are owned by or licensed to the Platform operator. You may not copy, reverse-engineer, or commercially exploit the Platform or any part of it without prior written consent.

7User-uploaded data and content

Users (real estate agencies) retain ownership of the data and files they enter into the Platform, while granting Mohassa a limited licence to store, process, and display that data to authorized users to the extent necessary to provide the service.

8Fees and subscription

Subscription fees are determined by the plan agreed between Mohassa and the real estate agency, as set out in the relevant proposal or agreement. Failure to pay outstanding fees may result in suspension of access to the service in accordance with the agreed terms.

9Limitation of liability

The Platform is provided as a tool for organizing and presenting data. Mohassa is not a party to the contractual or financial relationship between a real estate agency and its partners. Investment and financial decisions, and any liabilities arising from them, remain the sole responsibility of the real estate agency and its partners, to the extent permitted by law.

10Indemnification

You agree to indemnify Mohassa against any loss or claim arising from your breach of these terms, misuse of the Platform, or infringement of another party's rights.

11Suspension and termination

Mohassa may suspend or terminate access for any account that breaches these terms or is used in a way that endangers the Platform or its users, with notice to the user where reasonably possible. Users may also request closure of their account by contacting Mohassa.

12Availability and changes to the service

Mohassa seeks to keep the Platform continuously available, without guaranteeing it will be entirely free of interruptions, and reserves the right to develop the service, modify its features, or discontinue parts of it, with prior notice where possible.

13Governing law and dispute resolution

These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. The competent Saudi courts (including commercial circuits) have jurisdiction over any dispute arising from use of the Platform, unless another dispute-resolution mechanism is agreed in writing.

14Changes to these terms

Mohassa may update these terms from time to time. Your continued use of the Platform after an update is published constitutes acceptance of the revised terms. We recommend reviewing this page periodically.
